BGMI Ban News: Everything we know so far

BGMI, the most popular BR game in India, was recently banned by the government under the Section 69(A) of IT Act. Sources close to TalkEsport stated that this ban order is concerned with data privacy issues and BGMI’s links with China.

The ban was put into action three days ago as BGMI was removed from Google Play as well as Apple App Store. TalkEsport was the first to break the news of BGMI ban in India and Krafton being in contact with the officials to resolve this issue. A report by Reuters soon confirmed it and mentioned that the game was banned under IT Act Section 69(A).

The BGMI makers, Krafton Inc., is given a time of 14 days by the authorities to prove their innocence. Sources close to TalkEsport disclosed that Krafton is in the process of providing evidence that clears the data privacy issues and its links with China.

Indian government blocked the access to BGMI under the Section 69(A) of IT Act. Our preliminary report disclosed that the authorities have concerns over data migration policies and its Chinese connections. The official action was taken soon and Krafton has been working with the authorities since then to bring the game back in India.

IMPACT OF BGMI BAN IN INDIA

Battlegrounds Mobile India was the biggest esports title in India before it was blocked by the Indian Govt. a couple of days ago. This ban has adversely impacted the budding esports scene as tournaments came to a halt. Several gamers from the community have questioned this move.

BGMI made a stellar entry in esports after its launch in late 2021. The first official tournament had a prize pool of ₹1 crore and it has only grown from then onwards. Now, several third-party tournaments were lined up with a LAN final and prize pool in crores.

When BGMI was banned, all of these tournaments were paused and some were postponed indefinitely. Questions have raised over how this ban is affecting Indian esports as a whole.

Krafton faced a severe impact of this ban as their share value dropped drastically after the ban was announced. According to a report by Inc42, “Shares of Krafton, developer of Battlegrounds Mobile India (BGMI) game, tumbled as much as 9% on the Korean stock exchange on Friday (July 29) after BGMI was taken down from the Google Play Store and Apple’s App Store in India. Krafton shares ended the session 4.5% lower at 233,500 Korean won ($178.64).”

EVENTS THAT PRECEDED AFTER THE BAN:

  • It confers on the Central and State governments the power to issue directions “to intercept, monitor or decrypt any information generated, transmitted, received or stored in any computer resource”.
  • The grounds on which these powers may be exercised are:
    • In the interest of the sovereignty or integrity of India, defence of India, the security of the state.
    • Friendly relations with foreign states.
    • Public order, or for preventing incitement to the commission of any cognizable offence relating to these.
    • For investigating any offence.

The law reads:

69A. Power to issue directions for blocking for public access of any information through any computer resource

(1) Where the Central Government or any of its officer specially authorised by it in this behalf is satisfied that it is necessary or expedient so to do, in the interest of sovereignty and integrity of India, defence of India, security of the State, friendly relations with foreign States or public order or for preventing incitement to the commission of any cognizable offence relating to above, it may subject to the provisions of sub-section (2), for reasons to be recorded in writing, by order, direct any agency of the Government or intermediary to block for access by the public or cause to be blocked for access by the public any information generated, transmitted, received, stored or hosted in any computer resource.

(2) The procedure and safeguards subject to which such blocking for access by the public may be carried out; shall be such as may be prescribed.

(3) The intermediary who fails to comply with the direction issued under sub-section (1) shall be punished with an imprisonment for a term which may extend to seven year and also be liable to fine.

Sources close to TalkEsport have informed us that Krafton has presented its case to the government on the independence of its operations and data from Chinese influence.

They have further emphasized that the company’s data and other privacy matters and that the data are not handled irresponsibly.

This new evidence provided to the Indian government can turn into substantial proof for the case of Krafton. If the evidence is considered authentic and establishes that the connection between BGMI and China does not exist, there is a chance that BGMI’s ban might get lifted.

Krafton will also be meeting with MeitY officials in the provided time period to present such evidence and prove their innocence in this case. The provided time is very crucial for BGMI developers as it decides the fate of BGMI.

The future of BGMI in India is very uncertain right now as there are so many variables at play on the same time. Looking at all the facts presented until now, there is a strong possibility that BGMI may get unbanned after the meetings are concluded by the next weekend.

Gameplay changes in Apex Legends Season 14

A much-requested feature by the community, the level cap increase is finally coming to Apex Legends. The level cap will be increased to a staggering 2000 levels, meaning you can loop through 500 levels 4 times before maxing out the season pass. 

General weapon changes are as follows:

  • Laser Sights – A new barrel attachment for Pistols and SMGs, which significantly increase hip-fire accuracy. These laser sights can also be color customized, similar to reticle customization.
  • Spitfire – This weapon now takes light ammo/mags
  • Wingman – This weapon now takes sniper ammo/mags
  • EVA-8 – Not only can this weapon now take stocks and use double-tap hop-up, but it has an overall fire rate increase, that is boosted even more with Bolts.
  • Rampage LMG and Bocek Bow have been moved to Supply Drops.

Singapore developer and publisher of popular battle royale games PUBG Mobile and BGMI are finding it hard to remain on the good side of the Indian Government. Recently, their India-only Battlegrounds Mobile India mobile game received a ban from the Indian Government after it was discovered that the game was sending data and communicating with servers in China.

After the ban of BGMI, many content creators and professional teams announced that they will shift to New State Mobile, a futuristic battle royale game developed by Krafton. Since prior the other popular Krafton games are banned by the Indian Government, players and fans are worried if moving to the New State Mobile will be a good choice or not.

Since New State is now the main focus of the battle royale community in India, let’s clear some air around New State Mobile’s future in India.

New State Mobile is a futuristic battle royale mobile game set in some years in the future in the same PUBG universe.

Since the game is fully developed and published by Krafton without help from any 3rd party like Tencent, the chances of New State Mobile getting banned are very unlikely. Plus reading the privacy policy of the game also reveals that the data of Indian users is strictly stored and processed in servers in India and Singapore. 

Another point to note is that the game hasn’t even been launched in China yet. Since China has stopped screening games for launch in the country, almost no new games are able to get the mandatory approval for launch.

So a Chinese connection is not present at the moment. Hence it is safe to say that New State Mobile will likely not face any hurdles from the Indian government in the near future.

Aman Jain aka SouLAman, a member of the S8UL esports team in his latest stream also explained why New State Mobile will not be banned in India. He said that the game is fully developed and published by Krafton and has no third-party collaboration with Tencent or any Chinese company in it.

Indonesia Unblocks Steam, PayPal, And Yahoo After Licensing Spat

After a dispute over licensing, Indonesia has finally removed the restriction on the gaming platform Steam, as well as the block on the payment company PayPal and the search engine Yahoo.

Due to licensing concerns, the Indonesian government (Kominfo) temporarily barred the online gaming platform Steam, the payments firm PayPal, and the search engine Yahoo on August 1, 2022. However, they later lifted the ban.

Dota 2 and Counter-Strike: Global Offensive were two of the most popular games in Indonesia, but they were unable to be played after they were blocked. This caused the Indonesian gaming community to disintegrate into chaos. This past weekend was a rough one for gamers, but the situation is only expected to be temporary until the companies representing them comply with Indonesian legislation.

According to Indonesian law, the said companies have complied. Despite this, Origin and Epic Games have not publicly addressed the issue and their services are still prohibited.

The platforms, along with many others, had their access restricted on July 29th, 2022 due to licensing issues, and now those restrictions have been lifted. Because they did not comply with Indonesia’s law governing online platforms and services, the Indonesian government stopped access to Battle.net, Steam, Origin, and Epic Games on that date.

After demonstrating compliance with Kominfo and registering themselves as subject to Indonesian jurisdiction, the Indonesian government declared on Monday that Steam, PayPal, and Yahoo will be unblocked and restored to their previous condition.

The past couple of days have been challenging, but now that the platforms and services stated above have been unblocked, the gaming community in Indonesia should have a significantly more joyful week ahead of them. Indonesian gamers can now play Dota 2 and Counter-Strike: Global Offensive. On the other hand, this may also signify a substantial change to the gameplay system for gamers.

Epic Games and Origin are still unable to access the Indonesian market, and the companies have not yet provided the local community with an update on what they might anticipate in the near future.

According to a revealing piece published by the Electronic Frontier Foundation, the country of Indonesia is home to 191 million internet users who log on to various online platforms and services, including Instagram, Steam, and even Yahoo. The Constitutional Court of Indonesia ordered a law that empowers the government to limit internet access amid the turmoil.

Even if a company’s infrastructure is located outside of Indonesia, platforms and services still need to have a valid identity certificate. If Origin or Epic wish to sell games in Indonesia, they must register with the government. This decision grants the government the authority to force businesses to comply with the government’s demands or risk having their services or platforms taken away.

If a corporation refuses to let the government access its “systems and data to ensure efficacy in the monitoring and law enforcement process,” then that company will be in violation of the law. This business may receive a warning, and have its access revoked, temporarily restricted, or blocked altogether.

All foreign online platforms and services must register under Indonesian law. The Indonesian government will have the authority under the law to compel platforms to provide the data of specific users and to remove anything that violates the law.

Even if the firm infrastructure is outside Indonesia, platforms and services need a certificate. Origin or Epic games must register with the government to sell games in Indonesia. This judgment permits the government to force firms to comply or remove services or platforms.

If a corporation refuses to let the government access its “systems and data to ensure efficacy in the monitoring and law enforcement process,” then that company will be in violation of the law. This business may receive a warning, and have its access revoked, temporarily restricted, or blocked altogether.

For gamers, the licensing law grants the Indonesian government control over what is filtered to the public. This means that if the government determines that a game is inappropriate for public consumption, they have the legal authority to demand that the platforms remove it or prevent access to it.

In other words, if they consider Dota 2 or a cosmetic or feature in Counter-Strike: Global Offensive to be offensive or detrimental to “lawful order,” they have the ability to compel Steam to take the game down, make improvements, or delete the offending elements.

Ultimately, Indonesian gamers’ free speech and online activities will be controlled, and playing new and old games may become more difficult. With Indonesia’s government cracking down on platforms and services, it might become somewhat more difficult to properly explore the freedom of the internet, let alone play games online.

Bren Esports owner wanted in connection to drug smuggling case

Update: Bernard Chong – the owner of Bren Esports – has been cleared of drug smuggling charges by a court ruling. The Manila Regional Trial Court had previously implicated Chong in a drug smuggling operation at the Manila International Container Port, issuing a warrant for his arrest. However, the recent court ruling has now overturned this decision, clearing Chong of all charges.

Bernard Chong, creator, and owner of Bren Esports is wanted by the NBI for his alleged involvement in a shabu (methamphetamines) smuggling case worth $1.87 billion Philippine pesos ($33.6 million).

The investigation into the illegal transport of narcotics at the Manila International Container Port in the Philippines began in 2019. As one of the proprietors of Fortuneyield Cargo Services Corporation, which acted as the collector of the heroin shipment, Chong is said to have a connection to the drugs investigation.

The appeal was turned down on April 29, 2022, after which the arrest warrant for Chong was issued. The warrant was issued on June 2, 2021.
