A GTA 6 subpoena filed by Take-Two Interactive against Microsoft and Discord has been granted by a New York judge. The order, approved on August 21, requires both companies to hand over account, device, and cloud records tied to the leaker known as Cyberleek. Take-Two filed the requests on August 20 in the Southern District of New York as part of its effort to identify who leaked Grand Theft Auto 6 gameplay footage earlier this month.
Microsoft and Discord now have until September 4 to comply. Xbox has already responded publicly to confirm its cooperation.
GTA 6 Subpoena: What Happened in Court
Take-Two submitted two separate DMCA subpoena petitions on August 20, one directed at Microsoft and one at Discord. The company asked the court to authorize both requests as part of its search for the identity behind the Cyberleek persona.
According to a court order, a New York judge granted both petitions on August 21, just a day after they were filed. Take-Two’s counsel submitted a sworn declaration stating the subpoenas are meant only to identify alleged infringers, not for any other purpose.
Microsoft must now turn over internal business and investigative records connected to its own inquiry into the Cyberleek persona. This includes account details, linked services, IP addresses, device identifiers, and any OneDrive or GitHub content tied to the suspected accounts.
Discord’s subpoena covers a wider set of accounts and servers, including handles like CYBERLEEK, CINEMATICROCKSTAR, and Surfer24k, along with servers linked to the Odyssey.gg brand and a server associated with GTA content creator Matthew “DarkViperAU” Judge. Judge has publicly denied any connection to the leaks, stating his editors’ server does not contain any leaked clips.
Xbox Responds to the GTA 6 Subpoena
Xbox CTO Scott Van Vliet addressed the situation directly on X. He confirmed Microsoft’s cooperation with the investigation.
“We are working closely with Take-Two and Rockstar Games to support efforts to protect creative works and intellectual property,” Van Vliet wrote.
A Discord spokesperson also commented on the matter, noting that the platform regularly receives and complies with valid DMCA subpoenas as standard practice.
Cyberleek began leaking GTA 6 gameplay footage on August 18. The leaks have continued in stages, with the source appearing to hold a playable early build of the game.
The persona has also taken steps to profit from the situation. Cyberleek’s website recently added a “Contact” section offering paid “in-video ads” and “custom-made gameplay footage.” Anyone hoping to negotiate directly must first pay more than $164,000 in cryptocurrency. The leaked videos have also carried branding tied to a Solana memecoin since the first clips appeared.
Take-Two has not confirmed how the leaked material was obtained. Some reports have pointed to rumors involving an Xbox development kit, though this remains unverified.
The leaks arrived shortly before Rockstar’s planned extended gameplay reveal, set to stream on Netflix on August 27. Grand Theft Auto 6 remains scheduled for release on November 19, 2026, exclusively on Xbox Series X|S and PS5.
